General Fencing Information

It is a good idea for you to discuss your ideas and proposed design with your adjoining neighbour before you start. Remember the fence belongs to both you and your neighbour. It is much easier and quicker if you and your neighbour agree on as much as possible before you get any quotes.

You and your neighbour should also look at your fence line and discuss the removal of the existing fence and any overhanging trees, vines or obstructions which will make the task more difficult and time consuming for the contractor. If the contractors are going to be required to clear these items it is best to get an understanding of the costs involved and how this will be allocated to each neighbour.

We recommend that fencing work should not commence until a contract is signed by all parties and the specified deposit is paid. The parties should understand and be made aware of the terms and conditions of the contract. The contract may be varied by additional work or by omissions from the works. We recommend all variations would be in writing and signed by all parties.

It is the owners responsibility to provide the correct location of the boundary and fence line, to indicate the position of the survey pegs and to supply a plan of the site to assist in the location of the fence line. The owners are responsible to pay all costs if a check survey is to be undertaken by a licensed land surveyor.

One of the forms you may need is a notice to fence when negotiating with your neighbour. Please open the attachment.

We also have two guides to building a timber fence, we thank ATIF for access to their information.

Another very helpful website is the Quick Guide to Fencing created by the Law Reform Committee which will help you with the legalities of the fencing act. Please Click Here to enter this site.
